TERMS & CONDITIONS
The ‘conditions’ mean these terms and conditions of sale; ‘contract’ means the contract for the sale by Foster Bowes Limited (us) and purchase by you of our Goods and/or Services; ‘goods’ means bespoke or made to measure curtains, blinds, cushions and/or soft furnishings or any other goods made by us; ‘price’ means the price of goods and services; ‘we’/‘us’ means Foster Bowes Limited whose business address is Fairdown, Vernham Street, Andover SP11 0EL; ‘you and your’ means the person who buys or agrees to buy goods and/or services from us.
Quotations/Estimates
You will receive a written quotation/estimate, which will be valid for 28 days.
Client’s Own Fabric
Where a Client wishes to provide/purchase fabrics themselves, Foster Bowes Limited will add a Client’s Own Fabric ‘COF’ charge of 20% to Labour costs.
Orders, Samples & Deposits
All orders will be subject to acceptance in accordance with these terms and conditions. All made to measure orders are subject to a 60% deposit upon confirmation of the order. The balance of the order will become due on the day of collection / installation or prior to delivery. Title to the goods will remain with Foster Bowes Limited until full payment is received.
All orders will be subject to you confirming your chosen style, fabric and colour; samples are strongly advised to ensure colour and texture accuracy and can be provided upon request. Please note that once the fabric has been ordered and cut from the roll it becomes unreturnable to the manufacturer, and therefore cannot be exchanged. At this stage, deposits are non-refundable. Once an order has been confirmed, cancellations are at the discretion of Foster Bowes Limited. Images that are used are for display purposes only and may not reflect the final look of your made to measure items.
Linings
Unless otherwise stated, for curtains, the interlining used will be a pre-shrunk, medium intertherm cotton Domett and the lining will be cotton sateen. For interlined Roman blinds, the interlining will be a fusion bonded blackout lining (polyester and fleece); this gives the structured look to the blind. Other styles of blind will use the same lining and interlining as the curtains. Should you desire different linings, this must be expressly requested.
Measuring & Fitting
We will provide a comprehensive measuring service to ensure we provide you with an accurate price for our services and for the goods required to fulfil your order. Any measurements provided by you will only allow for a rough estimate and will not reflect the accurate final price. If you decide to proceed based on measurements taken by yourself then Foster Bowes Limited cannot accept liability for any inaccuracies caused by measurements taken by yourself. Re: internal structure of walls: Customers are requested to inform us of any electrics, pipes, steels etc that Foster Bowes Limited is not responsible for any problems that may arise through not having access to this information. It will be the customers’ responsibility to make sure that their walls or recesses are prepared prior to fitting of hardware. Final measurements will need to be taken, on site, once the hardware has been fitted. We need to be made aware of any window treatments or floor treatments that are due to be changed or installed as these will affect the final measurements. Foster Bowes Limited accepts no liability for the affect that any additional window or floor treatments have on the Curtains or Blinds we have made if we were not made aware of these prior to commencement of work. Foster Bowes Limited uses its professional opinion to determine the required widths, drops and projections of hardware in order to best dress the finished products. If you have a specific style/size in mind you must make us aware of this in writing and we can discuss whether or not it will work, practically, with the specifications of the room/window in question.
Health & Safety
Foster Bowes Limited installs all curtain and blind mechanisms and hardware in line with the stringent UK Government standards governing the manufacture, sale and installation of curtains and blinds.
Delivery
Lead times vary are approximately 16-22 weeks from receipt of Deposit [please note that this is assuming a 4 week lead time for fabric. Occasionally, a fabric may be out of stock and sometimes, without notice, may be discontinued by the manufacturer. You will be notified if either of these situations arise.
Price Changes
We reserve the right to make price changes. The price you pay is the price agreed by you upon signing your Acceptance of Order, with the following exception: while we try and ensure that all prices are accurate, errors may occur. If we discover an error in the price of goods we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. Therefore, we cannot confirm the price of your goods until your order is accepted. If we do not hear from you within 14 days, we will treat your order as cancelled.
Cancellation, Refunds & Returns
It is vital that you check all of the details of your order before confirming your order. Once an order has been confirmed and the deposit paid, it is at the discretion of Foster Bowes Limited if an order has progressed too far to be cancelled. You are advised to contact us as soon as you become aware there may be a problem with your order/specifications and we will see if we can seek a satisfactory resolution. Consideration of partial refunds on finished products will only be considered up to 7 days following installation and will not be considered where the balance payment has been paid. Refunds of deposits cannot be given on cancelled orders once an order has been confirmed and the fabric has been ordered and/or received by us. Hardware is ordered in specifically and is bespoke to your requirements. In the instance of bespoke hardware being ordered, these are non-returnable unless faulty. Some fabrics have natural characteristics such as slubs in the fabric and asymmetry as with linens and silks etc, these are not faults in the fabric. For the make-up of an interlined roman blind with blackout lining, a small stab stitch is required at spaced intervals to secure the 3 layers together. Sometimes light can penetrate through a stitch and this is not a fault in the making up of your blind, but a necessary stage that cannot be omitted.
Errors
We cannot accept any liability for errors made on your behalf.
Data Protection
We record some personal data such as name, delivery address and contact information. We do not store card payment information. Your data will not be passed/sold onto any third parties, with the exception being for the fulfilment of an order i.e. courier service.
Consumer Protection (distance selling) Regulations 2000
The Consumer Protection (Distance Selling) Regulations 2000 state a cooling off period of 7 days after ordering with the right to cancel an order, do not apply to goods made to a consumer’s specification or personalised goods, therefore excluding all made to measure goods.
Ownership of Rights
All rights including copyright in the website are owned by or leased by Foster Bowes Limited. Any use of this website or its contents, including copying or storing in whole or part, other than for own personal use, non-commercial use is prohibited within the written consent of Foster Bowes Limited. You may not modify, distribute or re-post anything of this website for any purpose without express permission.
Intellectual Property
You recognise and agree that all copyright, database rights, trademarks and all other intellectual property rights in all material and/or content of this website is owned by Foster Bowes Limited or our licensors and shall remain at all times vested in us or our licensors as express authorised by us our licensors.
Images
You recognise and agree that Foster Bowes Limited will take photographs of products in situ and store those images. Foster Bowes Limited may, at its discretion, use the images on its website or social media pages unless you expressly indicate, in writing, that you do not consent to this.
Severance
If any part of the Conditions shall be deemed unlawful, void or for any reasons unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the conditions.
Law
The Conditions shall be governed by and constructed in accordance with the laws of England and Wales and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
All of the above does not affect your statutory rights.
